2011 Ski/Board-A-Thon and Snowshoe Trek Waiver
LIABILITY RELEASE & PROMISE NOT TO SUE (For 2011 Ski/Board-a-thon and Snowshoe Trek Participants) I hereby verify that I/the individual named below is physically capable of participating in the TRAIL 2011 Ski/Board-a-thon. I understand and accept that there are many risks involved in this activity, including but not limited to: collision with other skiers and natural and man-made objects, injuries from the varied conditions of the trails, and all inherent risks of outdoor activities; and I willingly assume responsibility as a participant or parent/legal guardian of same.<br><br>In consideration of participation in the TRAIL 2011 Ski/Board-a-thon, I hereby release both TRAIL and Pat’s Peak, including their agents, owners, employees, volunteers and sponsors, from any and all liability for personal injury, death or property damage, resulting from negligence, conditions of the premises, operation of the area, actions or omissions of employees, the risks listed above, and accept for myself the full responsibility for any and all damage or injury of any kind which may result, holding participating facilities harmless from any and all claims. I agree that any suit or legal actions against facilities associated with TRAIL, their employees or agents shall be submitted only to the State or Federal Courts having jurisdiction in the State of New Hampshire and that no claims or actions shall be brought in any other jurisdiction. All claims shall be governed by the laws of the State of New Hampshire. If any part of this agreement is determined to be unenforceable, all other parts shall be given full force and effect.
